The Supreme Court upheld the position of the Khmelnytsky Oblast Prosecutor’s Office and upheld the decision of the Kamyanets-Podilsky City District Court, which upheld claims to stop the illegal use of land in the protected area of the Pokrovskaya Church monument of national importance.
The reason for the prosecutor’s response was that the decision of the session of the city council in 2012 transferred to the ownership of a local resident a plot of land with an area of 1 thousand square meters for the construction and maintenance of a residential building. This land belongs to the protection zone of the monument of national importance «Church of the Intercession», and therefore a special regime of use has been established for it and its allocation is possible only with the consent of the Ministry of Culture of Ukraine. In addition, the site is located within the coastal protection strip of the Smotrych River, where any construction is prohibited.
