On August 4, 2020, SAP prosecutors filed an indictment against the former Deputy General Director for Production Support of the Enterprise and the Director of the Eco-Service Trading House LLC.
The actions of the suspects are qualified under Part 5 of Article 191 of the Criminal Code of Ukraine («Appropriation, misappropriation of property or taking it by abuse of office»).
As NABU detectives found out during the investigation, in the period from February to May 2015, the ex-head of VostokGOK concluded additional agreements with the director of Eco-Service Trading House LLC to the contract for the purchase of minerals (sulfur) for the needs of the state enterprise. , which illegally increased prices by 31%, and further — by 57%. At the same time, the cost of purchasing sulfur increased gradually, as at least three intermediary companies were involved in the sale process. As a result of this scheme, the state-owned enterprise suffered losses of UAH 24.5 million.
Based on the materials collected by detectives during the pre-trial investigation, the National Bureau managed to cancel the agreements on the purchase of sulfur at the VostokGOK state enterprise at inflated prices. The court’s decision came into force, and thus — the basis was created to recover from a private company in favor of SE «VostokGOK» unreasonably overpaid UAH 25.4 million.
As part of the investigation, at the request of detectives of the National Bureau and prosecutors of the SAP, the corporate rights of the company worth more than UAH 11 million belonging to one of the suspects were seized and transferred to the ARMA department.
NABU detectives conducted investigations within this criminal proceeding from March 2018 to May 2020.
In the fall of 2019, the ex-director of VostokGOK and the head of Eco-Service Trading House LLC were informed about the suspicion. The pre-trial investigation against both persons was carried out in accordance with Art. 297-1 of the CPC of Ukraine (special pre-trial investigation), as they are wanted.
NABU detectives, together with the Ukrainian bureau of Interpol and with the participation of law enforcement agencies of a number of other states, are taking measures to establish the whereabouts of the accused and their detention.
Reservation. According to the first part of Article 62 of the Constitution of Ukraine, a person is presumed innocent of committing a crime and cannot be subjected to criminal punishment until his guilt is proved in a lawful manner and established by a court conviction.
