Under the procedural guidance of the Ternopil Oblast Prosecutor’s Office, an inspector of one of the Galician customs departments of the LCA of Ukraine was reported on suspicion of official negligence, which caused serious consequences (Part 2 of Article 367 of the Criminal Code of Ukraine).
According to the investigation, the customs officer improperly drew up materials on the movement of goods by the entrepreneur at a reduced price across the customs border of Ukraine. The inspector sent them for consideration by the court after the expiration of the term for bringing the guilty person to justice. The court found the business entity guilty of committing a customs offense, but the case was closed due to the expiration of the period of prosecution.
Due to the negligence of the customs official, the offender avoided liability for violating customs regulations. The state suffered losses amounting to UAH 1,817,000.
Pre-trial investigation in criminal proceedings is carried out by investigators of the territorial department of the DBR, located in Lviv.
Note: in accordance with Art. 62 of the Constitution of Ukraine, a person is presumed innocent of committing a crime and may not be subjected to criminal punishment until his guilt is proved in a lawful manner and established by a court conviction.
